As many of you undoubtedly know, Nevada voters narrowly approved in November a ballot measure requiring that private firearm transactions be subject to a background check on the buyer, as is required by federal law for purchases made from a Federal Firearms Licensee. Often referred to as a measure to "close the gunshow loophole" it mostly would affect private person-to-person transactions that previously required no background check if between two Nevada residents.
Days before the requirement was to go into effect on January 1, the Nevada Attorney General issued an opinion this Wednesday that the new measure would not be enforceable by Nevada law enforcement, effectively eliminating the requirement before it took effect. His reasoning was that the measure as written would have required all such transactions to go through the FBI system, and the FBI informed Nevada that the FBI wouldn't be in a position to serve that function. The FBI pointed out that this was a state requirement that the FBI wasn't in a position to administer. As you might imagine, the general impression is that there was a bit more to the AG's decision, but I only know what I read in the news.
Keeping in mind the Forum Guidelines, I wanted to post that information and ask: How do private firearms transactions work in your locale? Background checks or no? Does it matter as a practical point for firearm owners?
